Petitioner(s) Mr. Litan Maitra Ms. Rajnandini Das Mr. Ayan Biswas ... for the Petitioner(s) Ms. Arushi Rathore ... for the NCB Learned advocate for the petitioner submits that the subject-matter in the present case involves alleged recovery of 28 kg of ganja which were found behind a shop and the petitioners were found in close proximity of the contraband. Learned advocate also submits that the petitioners are in custody for more than 190 days; complaint has already been filed by the NCB; investigation is complete, as such, further detention of the present petitioners is unwarranted. Learned advocate for the NCB opposes the prayer for bail and submits that the petitioner no.1 has previous antecedents.
Refuting such contention, learned advocate for the petitioner has referred to the Judgment in connection with
Sinthi PS Case No. 70 dated 26.05.2016 wherein the petitioner no.1 was acquitted of the charges. Having considered the period of detention of the present petitioners and the fact that complaint has already been filed and the prosecution has relied upon eight witnesses in order to prove its case as also the fact that some time will be required to take the trial to its logical conclusion as charges have not been framed, I am inclined to enlarge the petitioners on bail.
Hence, the prayer for bail of the petitioners is Allowed.
Accordingly, the petitioner viz, Bablu Das and Shiv Charan Das shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Special Judge (NDPS Act), Barrackpore, North 24 Parganas.
If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of North 24 Parganas without prior intimation to the learned Special Court/trial court.
Additionally, the petitioners shall meet with the investigating officer of the case or any other officer deputed
by the Superintendent, NCB once in a fortnight till charges are framed before the learned Special Court.
Accordingly, CRM (NDPS) 659 of 2026 is allowed. Report submitted be kept with the record.
