Petitioner being aggrieved by non-execution return of distress warrant in connection with Misc. Execution Case no. 51/2024 which is pending before the learned Judicial Magistrate, 2nd Court, Serampore, Hooghly has approached this Court.
State has submitted a report. Report reflects that on 03.04.2025 distress warrant has been executed and four items were seized from the possession of respondent no.4 i.e. Sandip Sharma at his residence under proper seizure list in presence of witnesses and duly signed by them.
To that effect police authorities are directed to immediately submit the report before the learned Judicial Magistrate, 2nd Court, Serampore, Hooghly. In case private respondent again do not appear on 19.04.2025, learned Magistrate would proceed to the next step for execution of a warrant of arrest in connection with Misc.
Ex. Case no. 51/2024. In the alternative if the private respondent appears and deposits to the satisfaction of the Court, learned Court will be at liberty to exercise his discretion in accordance with law.
With the aforesaid observations WPA 6760 of 2025 is disposed of.
Report so submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner.
State is directed to immediately communicate this order to the Inspector-in-Charge, Dankuni Police Station for taking necessary and appropriate action.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
