The petitioner has filed an application before the Prescribed Authority and the Block Development Officer praying for removal of the Upa-Pradhan of the Chaltaberia Gram Panchayat.

The said letter was received by the office of the Prescribed Authority on March 12, 2021, but in view of the Model Code of Conduct published by the Election Commission of India which was

prevailing during that point of time, steps could not be taken by the respondent authorities.

Presently the election is long over and the result has been declared. There is no bar at this stage in taking steps for removal of the UpaPradhan. In view of the above, the instant writ petition is disposed of by directing the Prescribed Authority and the Block Development Officer being the respondent no.8 to take necessary steps in response to the letter filed by the petitioner, strictly in accordance with law, at the earliest, but positively within a period of six weeks from the date of communication of a copy of this order.

WPA 7603 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for be given to the parties after completion of all legal formalities.
