Mrs. Pampa Dey (Dhabal), Mr. Nikhil Kr. Gupta ....for the petitioner The petitioner has been living away from his residence Jagannathpur Village under Joypur Police Station since after December 2015.

FIR being Joypur PS Case No. 193/15 dated 18.12.2015 was registered against the petitioner under Sections 341/324/325/34 of the IPC.

The petitioner states that he and his family members are unable to return to their residence out of fear and intimidation by the private respondents. The Joypur Police Station has filed a report dated 20.02.2023, which is taken on record.

It is submitted that charge sheet being No.

Joypur Police Station Charge Sheet No. 103/16 has also been filed on 30.09.2016.

It appears from the report that the petitioner has voluntarily left his residence. He has not agitated his grievance after 2017 until 2021.

In that view of the matter, this Court directs the petitioner to return to his residence at

Jagannathpur village.

In the event of any apprehension, the Joypur Police Station shall extend necessary security to the petitioner only to return to his residence.

The Joypur Police Station shall keep strict vigil so that the petitioner may live peacefully.

In view of the above, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
