(DB) No. 1063 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Shyampur Police Station Case No. 477 of 2021 dated 02.12.2021 under Sections 363/365/342 of the Indian Penal Code and under Sections 17/8/10 of the POCSO Act.

And In Re : Sita Manna ..... petitioner Mr. Siddhartha Sankar Roy ... for the petitioner Mr. Avishek Sinha ... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Bail prayer of the petitioner was rejected earlier on merits. There is no change in circumstance since then. Allegations involve sexual assault on minors. In view of the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to examine the minor victims at the earliest.

Parties shall communicate copy of the order to the trial court for necessary compliance.
