Mr. Partha Pratim Das Ms. Manasi Roy ...for the State The petitioner renews his prayer for bail. He has been in custody for 438 days. He says that the charge sheet has been filed and his further custodial detention is not necessary.

We have seen the material in the case diary and the statements of eye witnesses recorded under Sections 164 and 161 of the Code of Criminal Procedure. It appears that there was a fight between the victim and the petitioner and the petitioner chopped off part of the victim's left hand.

We have considered the order dated October, 20, 2020 whereby a Co-ordinate Bench of this Court rejected the petitioner's prayer for bail in CRM 799 of 2020. On an overall assessment of the facts and circumstances of the case and the nature and gravity of the offence coupled with the grievous injury suffered by the victim, we are not inclined to allow the petitioner's prayer for bail at this stage.

Accordingly, the application for bail being CRM 2728 of 2021 is dismissed.
