On the prayer of the learned advocate for the petitioners, leave is granted to add Block Land and Land Reform Officer, Krishnaganj Block as a party respondent in this writ petition.
The petitioners claim to be the owners of a plot of land being L.R. Dag No. 555 within Mouza Krishanganj, J.L. No.39 in the District of Nadia. The petitioners state that a PWD road is running adjacent to the aforesaid property of the petitioners and the private respondent has constructed a tea stall on the PWD road thereby causing obstruction to the ingress and egress of the petitioners from their property to the PWD road.
The learned advocate appearing for the private respondent denies the allegation made by the petitioners. Mr. Bhattacharya, learned advocate appearing for the petitioners submits that after filing of the writ petition the petitioners were served with the letter dated 25th March, issued by the Assistant Engineer, Krishnanagar Highway Sub-Division II, Public Works (Roads) Directorate requesting the Block Land and Land Reform Officer, Krishnaganj Block to undertake a joint demarcation programme for taking further action and to fix a date for such programme.
The learned advocate appearing for the State submits that necessary steps in accordance with law shall be taken if any encroachment upon the PWD road is found.
Without entering into the merits of the claim made by the petitioners in the representation dated 25th January, 2026, WPA 6907 of 2026 stands disposed of by directing the Block Land and Land Reform Officer, Krishnaganj Block being the added respondent herein to carry out a joint demarcation programme within a period of eight weeks from the receipt of a server copy of this order as per the request made by the Assistant Engineer, Krishnanagar Highway Sub-Division II, Public Works (Roads) Directorate by a letter dated 25th March, 2026 upon prior service of notice to the petitioners, the private respondent and any person who may be affected by such
demarcation and after such demarcation the demarcation report along with the sketch map shall be forwarded to the petitioners, the private respondent and the Assistant Engineer, Public Works Department, Krishnanagar Highway Sub-Division being the 4th respondent who shall upon receipt of such report, if any encroachment upon the PWD road is found initiate necessary proceeding in accordance with the relevant statute and the entire exercise shall be completed as expeditiously as possible but positively within a period of eight weeks from the receipt of a copy of such report. If the said respondent authority finds that there has been no encroachment upon the PWD road such decision shall also be communicated to the petitioners and others within the time limit mentioned hereinbefore.
There shall be however no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
