The grievance of the petitioner does not survive in view of the subsequent development.

The respondent no.4 surrendered before the learned jurisdictional Magistrate, namely, the learned Additional Chief Judicial Magistrate, Barrackpore in connection with G.R. Case No.5865 of 2018. By an order dated July 6, 2021, the respondent no.4 was released on bail upon furnishing bail bond of Rs.1,000/- with one registered surety of like amount. The bail bond furnished by the surety was accepted by the learned Magistrate. Photocopy of the order granting bail is taken on record.

Under such circumstances, the allegation that the police authorities had failed to execute the warrant of arrest, does not survive.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
