Adil Badr Mr. Pratik Bose ... for the State Learned counsel for the petitioner submits that other than the statement of a co-accused, there is no other material available against the petitioner. Charge-sheet has been submitted.

Learned counsel for the State opposes the prayer for anticipatory bail and submits that other than the statement of a co-accused, there are phone call records between the petitioner and the principal accused at the relevant time. Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.
