1. This revisional application has been filed seeking expeditious disposal of Revocation Case No. 03 of 2023 pending before the learned District Judge at Alipore, South 24- Parganas.

2. Mr. Sen, learned senior advocate appearing for the petitioner's submits that the application for revocation of grant of probate had been filed on March 09, 2023 and the same has been pending since then without much progress.

3. It is submitted that the only two issues involved in the instant proceeding for revocation are as to whether a second probate can be granted after an earlier probate has already been granted and whether the petitioner being a grantee of probate of an earlier will has a right to be put on notice and is entitled to citation in the subsequent proceeding for probate.

4. In view of the nature of the order proposed to be passed direction for prior service of copy of this application along with notice on the opposite parties

is not being made, however, the petitioner shall remain obliged to serve a copy of this application along with a copy of this order upon the opposite party within a week from date.

5. Having heard the learned senior advocate appearing for the petitioner and having considered the material on record, this revisional application is disposed of by requesting the learned District Judge at Alipore, South 24- Parganas to dispose of the Revocation Case No. 03 of 2023 pending before the said court as expeditiously as the business of the learned Trial Court would permit and preferably within a period of eight months from the next date fixed without granting any unnecessary adjournment to either of the parties.

6. With the above observations, CO. 1030 of 2026 stands disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
