It is submitted by the learned counsels appearing on behalf of the parties that against the order passed under Section 10(3) of the West Bengal Highways Act, 1964 (hereinafter referred to as "the Act") the petitioner has preferred an appeal under Section 10(4) of the Act which is pending.
Learned counsel appearing on behalf of the petitioner submits that he has instruction to withdraw this writ petition and approach the appropriate forum for redressal of his grievance.
In view of the same the writ petition is dismissed for non-prosecution.
Since the appeal under Section 10(4) of the Act is pending, the petitioner is at liberty to approach the appropriate forum for redressal of his grievance. There shall be however no order as to costs.
