The grievance of the petitioner in the present writ application is that even after completion of the work awarded to the petitioner, the respondent authorities have released the earnest money of the petitioner after the period one and half years. Accordingly, he prays for interest upon the delayed payment of the earnest money to the petitioner. Learned Advocate for the petitioner submits that the work was completed on 15th March, 2023, but the earnest money was released on 26th September, 2024 and as such, the petitioner is entitled to interest

@18% per annum from 15th October, 2023 to 26th September, 2024.

Learned Advocate for the petitioner further submits that the petitioner has made representation to the Executive Engineer, Birbhum, Hooghly Division-I, P.W.(Roads) Directorate, Sarak Bhaban Lambodarpur, Suri, Birbhum, West Bengal on 25th November, 2024, but till date the representation filed by the petitioner has not been disposed of.

This Court finds that no purpose would be served by keeping the writ petition pending. Accordingly, the writ petition is disposed of by directing the Executive Engineer, Birbhum, Hooghly Division-I to consider the representation of the petitioner dated 25th November, 2024 and to pass a reasoned order within a period of six weeks from the date of receipt of this order and to communicate the decision to the petitioner within a period of one week thereafter.

With the above observations, the instant writ petition, being WPA 7035 of 2025, is disposed of. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
