The petitioner is aggrieved by the act and action of the respondent no.5 who along with other miscreants entered her house with deadly weapons and there are allegations of outraging her modesty. State has submitted a report which reflects that consequent to the information furnished, Nadial Police Station Case No.

dated 09.12.2024 has been registered for investigation under the relevant provisions of BNS as well as the Arms Act.

The petitioner alleges that she has no complaint regarding the registration of the FIR, but petitioner is being constantly threatened for which she is unable to lead her normal life.

Having considered the same, I am of the view that since a criminal case is pending and the petitioner happens to be a witness, if the petitioner applies before the learned Magistrate in seisin of Nadial Police Station Case No.

dated 09.12.2024, learned Magistrate will call for a threat perception report from the police authorities and thereafter pass necessary direction under the provisions of Witness Protection Scheme, 2018. It has been submitted that the police authorities have been keeping a strict vigil and also have been conducting raid. The police authorities would ensure that no further untoward incident results at the behest of the private respondentno.5 or his associates as is complained of by the petitioner.

Needless to state that since no affidavits have been called for, the allegations and/or accusations made in the writ petition are deemed not to have been admitted.

With the aforesaid observations, the writ petition being WPA 6656 of 2025 is disposed of. There will be no order as to costs.
