Mr. Gunjan Shah Ms. Shreya Agarwal Mr. Subhasish Dutta Ms. Soumili Sarkar ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Judge, 6th Bench at City Civil Court at Calcutta to dispose of the Money Suit No.528 of 2017 expeditiously.

The learned advocate appearing for the petitioner submits that the learned Trial Judge has mechanically extended the time to file written statement without appreciating that the statutory period for filing the written statement has long expired.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.

From the order sheets appended to this application this Court finds that May 8, 2025 has been fixed for filing of the written statement by the defendant.

In case written statement is not filed within the time indicated in the order dated February 11, 2025, the learned Trial Judge shall proceed with the suit in accordance with law.

With the above observations CO 1058 of 2025 is disposed of by requesting the learned Trial Judge to dispose of the Money Suit No.528 of 2017 as expeditiously as possible preferably on or before December, 2025 without granting any unnecessary adjournments to either of the parties.

This order has been passed considering the fact that the Money Suit is of the year 2017.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
