Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 7 months and charge sheet has already been submitted. Prosecution has relied upon 36 witnesses in order to prove its case. So far as the nature of the dispute complained of, according to the petitioner, the same was because of certain provocation and a long standing dispute for throwing of garbage.
Learned advocate appearing for the State opposes the prayer for bail and submits that the offence is a heinous
offence and the victim succumbed to the assault inflicted by the petitioner and another.
Having considered the genesis of the dispute and the fact that prima facie, the conduct of the present petitioner do not reflect that he has criminal antecedent and the issue on which the disputes cropped up, I am of the view that further detention of the present petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Praloy Saha @ Pralay Saha shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Kalna, Purba Burdwan. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purba Burdwan without the prior permission of the learned Trial Court.
Additionally, petitioner shall not enter the jurisdiction of Nadanghat Police Station.
Accordingly, CRM (M) 759 of 2026 is allowed.
