Heard learned Advocates for both the parties. It is submitted on behalf of the petitioners that despite their applications before the respondents for mining lease in their favour, the respondents have not initiated the process of auction as referred to in Annexure-P4 at page 19, which is a reply sent by the respondents to the petitioners.

Learned Advocate for the respondents submits that by an order dated 30th July 2021, the West Bengal Mineral Development and Trading Corporation Limited has been authorized to deal with the matters relating to mining lease.

The petitioners are, therefore, at liberty to apply before the said competent authority within two weeks from date and the competent authority is directed to dispose of the said application in accordance with law after giving an opportunity of hearing to the affected parties including the petitioners, within three months from the date of receipt of the application.

WPA 7628 of 2021 is disposed of accordingly.

There will be no order as to costs.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.

Let certified copy of this order, if applied for, be given to the parties on priority basis.
