Tarit Kr. Chakravorty v. West Bengal Housing Board And ORS.
AD-08 Ct No.09 28.02.2024 TN WPA No. 6385 of 2022 Sri Tarit Kumar Chakravorty Vs.
West Bengal Housing Board and others Mr. Partha Sarathi Das, Mr. K. Biswas, Mr. Pratyush Ghosh .... for the petitioner Mr. Paritosh Sinha, Mr. Amitava Mitra, Ms. Antara Choudhury .... for the respondent nos. 1 to 4
1. Learned counsel for the petitioner contends that the petitioner had been allotted a garage space in the year 1991. However, the same has not yet been registered in the name of the petitioner despite the petitioner having approached the West Bengal Housing Board on several occasions.
2. Learned counsel appearing for the respondentauthorities submits that the petitioner was required to pay additional charges including the cost of the garage, which were not paid by him. Moreover, the present representation has been made by the petitioner after a long delay of several years.
3. Be that as it may, learned counsel for the respondentauthorities submits that keeping in view the advanced age of the petitioner, the Housing Board is not taking a technical objection as to delay. However, the
representation given by the petitioner, as annexed at page-37 of the writ petition, shall be considered by the respondent no.3.
4. Upon query of court, learned counsel for the respondents submits that primarily the remaining issue is the payment of the amount required by the petitioner and, upon an inspection of the said locale if it is found that any steps are to be taken by the petitioner for ensuring ingress and egress to the garage space, the said work is also required to be undertaken.
5. To thrash out all issues as indicated above, the best course of action is as suggested by learned counsel for the respondents.
6. Accordingly, WPA No. 6385 of 2022 is disposed of by directing the respondent no.3 to decide the representation dated February 10, 2022 given by the petitioner, as annexed at page-37 of the writ petition, upon giving an opportunity of hearing to the petitioner, within three weeks from date.
7. Upon such hearing being given, the respondent no.3 shall disclose to the petitioner, preferably in writing, the requirements which are to be complied with by the petitioner for registration of the garage space in the name of the petitioner, within three days after such hearing.
8. Upon such intimation being given and the petitioner complying with such formalities, the registration shall
be done in favour of the petitioner regarding the garage space preferably within three weeks from the date of such compliance of the formalities by the petitioner.
9. The parties shall act on the server copy of this order.
10. There will be no order as to costs.
11. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
