During the pendency of the revisional application there has been change of circumstances and the parties have arrived at an amicable settlement.

Records reflect that the present petitioner instituted the case at Bidhannagar (North) Police Station while there was also a case pending at the Hon'ble Bombay High Court at the instance of the private opposite parties. For the purpose of recording the statement of the petitioner/complainant viz Ananya Ghosh, a report was called for earlier.

A report was submitted before this Court enclosing the statement along with a declaration.

The statement and the declaration reflect that after the case was instituted by the private opposite parties, the Hon'ble Bombay High Court today i.e. 03.08.2023 has quashed the proceedings, the petitioner/complainant herein has expressed her willingness for not proceeding with Bidhannagar (North) Police Station Case No.108 of 2019 dated 06.08.2019.

Having regard to the information which has been furnished by Mr. Mukherjee, learned senior advocate appears for the private opposite parties, it is noticed that the proceedings before the Hon'ble Bombay High Court has been quashed and which is acknowledged by Ms. Patel, learned advocate appearing for the petitioner. Under the aforesaid circumstances, I am of the view that further continuance of the proceedings in the changed circumstances is unwarranted.

Accordingly, all further proceedings including the charge-sheet so submitted in connection with Bidhannagar (North) Police Station Case No.108 of 2019 dated 06.08.2019 is hereby quashed.

The aforesaid order is restricted for the purpose of the present proceedings and will not be a precedent in respect of other cases where the parties may think of compromise. With the aforesaid observations, CRR 808 of 2021 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of such requisite formalities.
