The petitioners claim that the private respondents in violation of a compromise decree, are disturbing the possession of their property.
The petitioners have not been able to demonstrate particulars of any such compromise decree. There are references to other suits being Title Suit No. 122 of 1964 and Title Suit No. 285 of 1992. The remedy of the petitioners, if any, is to seek appropriate civil relief against the private respondents. Officer-in-charge, Kashipur Police Station have no role to play in the matter except to ensure that there is absolutely no breach of peace in the area and to continue to maintain strict vigil thereat. With the aforesaid observations, the instant writ petition shall stand disposed of.
Instructions of the Officer-in-charge, Kashipur Police Station, Baruipur Police District dated 24th August, 2022 addressed to the State Advocate be taken on record.
There will be no order as to costs.
