1. Learned advocate appearing on behalf of the Bank submits, upon instruction that, challenging the selfsame cause of action, a securitization application has been filed by the petitioner before the Learned Debts Recovery Tribunal which is pending disposal.

2. Since none appears for the petitioner at the time of call, the writ petition stands dismissed for default.

3. It will be open for the Tribunal to proceed with the application in accordance with law.

4. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
