Petitioners are aggrieved by the action of the private respondent nos. 4 and 5, who are interfering with the cultivation and peaceful possession of the petitioners. To that effect the police authorities were informed however, the police authorities inspite of directions of the Civil Court have not acted in accordance with law. State has submitted a report. Report reflects that Misc. Appeal case no. 13/2016 is pending and the next date is fixed on 14.06.2023. Report also reflects that at the relevant period of time police authorities have drawn up proceedings under Section 107/116(C) of the Code of Criminal Procedure.

Having considered that the police authorities were informed on 30th January, 2023 and more than two years have passed since then and further progress before the Civil Court has not been apprised to this Court, I direct in case petitioners are facing the same inconveniences they

would be at liberty to approach the police authorities with a fresh representation which police authorities would consider in accordance with law.

With the aforesaid observations WPA 6924 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
