The Kolkata Municipal Corporation is represented by the learned Advocate.

In pursuance of the direction passed by this Court a report is submitted by the Joint Commissioner of Police (Crime), Kolkata which is handed over by the learned Advocate for the State during course of hearing. The report submitted by the Joint Commissioner of Police (Crime), Kolkata indicates that during pendency of this appeal the authorized appellant of Kolkata Municipal Corporation, namely, Dr. S.K.Basu, Senior Superintendent, Health Department, Calcutta Municipal Corporation has been expired on 23.6.2025.

A photocopy of certificate of death of the said appellant is tagged with the record which also affirms his death during pendency of this appeal. 4.
The said report also states that the proprietor of the respondent Republic Bakery was also expired on 31st December, 2024 at his native village at Khanakul Sulutgram, Hooghly.

As the authorized representative as well as the accused respondent both are expired, the instant appeal should be decided/ disposed of on merit. 6.
I have gone though the impugned judgement and order passed by the learned Trial Court dated 22.5.1998, and after going through the said judgement, I find nothing to interfere with it.

Accordingly, the instant appeal be and the same is hereby dismissed on merit affirming the impugned judgement and order passed by the learned Trial Court dated 22.5.1998.

Let the report submitted by the Joint Commissioner of Police (Crime), Kolkata be kept on record.

Let a copy of this order along with Trial Court Record be sent down to the learned Trial Court immediately.
