Panda ... for the respondent no.4 Learned advocate representing the Kolkata Municipal Corporation has filed a report before this court wherefrom it appears that a joint inspection was conducted in the presence of the Block Land and Land Reforms Officer. Plot of land of the petitioner has been identified. The said plot is not well demarcated. The authorities have come to an opinion that the plot identified by the petitioner is under Dag No.711 situated under Ward No.131 of the Kolkata Municipal Corporation.

The authorities have taken a decision to restore the address of the petitioner to premises No.457, Maharani Indira Debi Road.

The Kolkata Municipal Corporation shall do needful to record the address of the premises of the petitioner as No.457, Maharani Indira Debi Road, in place and instead of 500, Joyrampur Jala Road. The impugned order dated 1st October, 2021 passed by the Assessor-Collector (SS Unit), Kolkata Municipal Corporation, is accordingly, set aside. The Assessor Collector is directed to make the necessary correction in the official records positively within a period of six weeks from the date of communication of this order.

It is made clear that the Court is not deciding the issue of title of the property in question and it will be open for the parties to agitate their claim before the appropriate forum in accordance with law, if so advised. The report filed by the Kolkata Municipal Corporation in Court today is taken on record. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
