Smt. Uma Dey @ Uma Bagchi This is an application under Section 482 of the Code of Criminal Procedure, 1973 for quashing of the proceedings being A.C. No.1627 of 2014 (T.R. No.432 of 2014), pending before the Court of the learned 7th Judicial Magistrate at Alipore under Sections 500/501 of the Indian Penal Code.

The matter was heard before the Coordinate Bench on 27th February, 2015 when direction was given to the petitioner to serve copy of the revisional application upon the opposite party and also the Hon'ble Court further pleased to grant an order of interim stay of all further proceedings in Case No.AC 1627 of 2014 for a period of six weeks. The matter again appeared on April 1, 2022 when none appeared on behalf of the parties and direction was given to the learned Registrar Administration (L & OM), High Court, Calcutta to issue notice to the petitioner and the opposite party through their respective police stations. On May 6, 2022, learned advocate on behalf of the petitioner appeared and Department placed a report indicating service has been made upon the petitioner as well as the opposite party. However, the opposite party remained un-represented.

After hearing, the Hon'ble Court was pleased to direct the petitioner to file a copy of the complaint of A.C. Case No.1627 of 2014 pending before the learned Judicial Magistrate, Alipore. Thereafter on June 20, 2022, when no such copy could be filed, the matter was directed to go out of the list with liberty to mention the matter after filing of Supplementary Affidavit alongwith a copy of the complaint, as stated above.

Today, none appears on behalf of the parties. The matter was running in the Warning List since February 20, 2025. In view of the long pendency of the matter as well as the conduct of the petitioner, who failed to comply with the directions of the Hon'ble Court, this Court is of the view that there is no reason to keep the matter pending further.

Accordingly, criminal revisional application being, C.R.R. 610 of 2015 and the connected application stand dismissed for default. Let a copy of this order be sent to the concerned Court below by the Department forthwith.
