Mr. Sukhendu Bikash Mukherjee ... For the Petitioner. Mr. Debjit Mukherjee Ms. S. Chatterjee ... For the State. The grievance of the petitioner is directed against non-consideration of his representation dated 3 September, 2020 for compassionate appointment of petitioner in place of her deceased husband who died in harness. (Annexure-P/3 at page 22 of the writ petition). It is submitted on behalf of the petitioner despite a period of more than four years having lapsed the concerned respondents have taken no steps for adjudication of the above representation.

The State respondents are represented and do not admit the allegations made in the writ petition. However, it is fairly submitted on behalf of the State respondents they have no objection if the representation dated 3 September, 2020 is disposed of in accordance with law.

In view of the above, WPA 7309 of 2024 stands disposed of by directing the concerned Block Development

Officer being the respondent no. 6 to consider and dispose of the representation dated 3 September, 2020 within a period of eight weeks from the date of communication of this order and in accordance with law.

It is made clear that there has been no adjudication on the merits of the case and the respondent no. 6 is to act strictly in accordance with law without being influenced by any observation and after hearing all the affected parties.
