It appears from the record that the petitioner being the husband has filed this application under section 407 of the Criminal Procedure Code, 1973 praying for transfer of Misc. Case no. 193 of 2017 pending before the learned Additional Chief Judicial Magistrate at Katwa, Burdwan to the learned Chief Judicial Magistrate at District and Sessions Judge, Burdwan (East).

In spite of filing this application in the year 2018, nobody appears on behalf of either of the parties on call. Even on earlier occasion no one represented the petitioner, no accommodation sought for. It indicates that the petitioner is no more interested in the instant case. Accordingly, CRR 909 of 2018 is dismissed for default.

Interim order, if any, stands vacated.

Let a copy of this order be communicated to the learned court below immediately for information.
