The petitioners claim that they are the owners of the lands comprised in R.S. Plot Nos. 406 and 407 under Mouza : Mansinghber, having Khatian No. 543 in the District of Purba Medinipur.

The petitioners allege that 7 decimals of land out of total 26 decimals of land in the Dag No. 406 was acquired by the State in L.A. Case No. (R & A) 27 of 1978/79 and possession of 23 decimals of land out of 34 decimals of land in Dag No. 407 in the said Mouza was also taken by the State without any acquisition proceeding.

The further grievance of the petitioners is that no compensation has been paid to them till date. The petitioners on January 09, 2021 for redressal of their aforesaid grievance gave a representation to the Land Acquisition Collector,

Tamluk, Purba Medinipur, the respondent no. 2 herein.

The petitioners pray that the said respondent no. may be directed to dispose of the said representation expeditiously.

W.P.A 7659 of 2021 is disposed of by directing the respondent no. 2 to dispose of the said representation of the petitioners appearing at page 21 of the writ petition being Annexure "P-4" in accordance with law by a reasoned order within a period of three months from the date of communication of this order after giving the petitioners an opportunity of hearing.

The petitioners are required to serve a complete copy of the writ petition along with the copy of this order upon the respondent no. 2 within a period of two weeks from date.

After the disposal of the said representation, the respondent no. 2 shall communicate his decision to the petitioners.

Since no affidavit-in-opposition has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents. No order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
