Memo of Evidence submitted by the learned advocate appearing for the State be also kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 07.01.2025; chargesheet has already been submitted and charges have already been framed under Section 12 of the Protection of Children from Sexual Offences Act, 2012 and Sections 77/78 of the Bharatiya Nyaya Sanhita, 2023.

Learned advocate appearing for the State opposes the prayer for bail.

Having considered the nature of the allegations and the fact that the petitioner is in custody for substantial

period of time, I am of the view that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the POCSO Act, Barrackpore.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court. The petitioner shall also not enter the jurisdiction of Bhatpara Police Station till the evidence of the victim is completed before the learned Special Court and inform the court before his release in respect of the address where he would be residing.

The application for bail, being CRM (R) 31 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
