The petitioner is aggrieved by the rejection of the application for transfer of the petitioner on medical grounds by the head of the institution for that there are only two-teaching staff.

An application for transfer on medical grounds cannot be rejected by the head of the institution in the manner indicated in the order impugned. Hence, the impugned order shall stand set aside and the head of the institution shall refer the petitioner's application for transfer along with medical documents to the medical officer of School Managing Committee or the local BMOH and take further steps in terms of the of 2015 Rules. With the aforesaid direction W.P.A. No.6414 of 2022 is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
