The Superintendent of Police, Baruipur Police District has filed a report dated 4th April, 2023 and the same is taken on record.

Let a copy of the report be made available to Mr. Samim, learned counsel for the petitioner.

It appears from the report that adequate security has been provided to the petitioner's daughter. The Superintendent of Police, Baruipur Police District has further indicated that Baruipur Police Station Final Report False No.254/23 dated 7th January, 2023 has been filed.

The petitioner shall be entitled to make an application under Section 173(8) of the CrPC in respect of the charge sheet in respect of FIR No. 67 of 2022 as well as the aforesaid Final Report dated 7th January, 2023.

Let a copy of the aforesaid Final Report be made available to Mr. Samim, learned counsel for the petitioner.

Since Mr. Samim submits that there is a possibility that the investigating officer may have misconducted himself at the instance of the accused, who is associated with a local MLA, the prayer for transfer of investigation and prosecution to another agency is left open to be raised afresh in future. With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
