The revisional application was preferred challenging the order dated 25th February, 2021 passed by the learned Additional Chief Judicial Magistrate, Uluberia.
The order dated 25.02.2021 reflects that charge-sheet was submitted before the jurisdictional court and the learned Magistrate was pleased to take cognizance of the offence. During the pendency of the present revisional application, it reflects that the parties have entered into a compromise. A report was called for.
Mr. Santanu Chatterjee, learned advocate appearing for the State submits a report which encloses the statement of the complainant, namely, Sanchita Roy.
Let the report along with the enclosure be kept with the record.
In view of the contents of the statement, it reflects that the couple presently is living a conjugal life happily and the private opposite party no.2 do not intend to pursue with the criminal case, I
am of the opinion that further continuance of criminal case where the matrimonial dispute and difference have been settled should not be allowed to continue.
In view of the aforesaid observations, all further proceedings of Uluberia Police Station Case No.346 of 2020 dated 29.12.2020 under Sections 498A/406 of the Indian Penal Code is hereby quashed.
Accordingly, CRR 812 of 2021 is allowed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
