23.03.2023 Ct. No. 29 CHC Rejected C.R.M.(A) 1190 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Farakka Police Station Case No. 372 of 2022 dated 24.09.2022 under Sections 363/365/34 of the Indian Penal Code.

And In the matter of : Samir Das @ Samir Kumar Das & ors. ...... petitioners Ms. Chandrima Debnath ....for the petitioners Smt. Sreeparna Das ....for the State The victim is yet to be recovered.

According to the State ever since the police complaint, the petitioners were not found so also the vehicle involved. Considering the fact that the victim is yet to be recovered and considering the involvement of the petitioners in the incident as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioners. CRM (A) 1190 of 2023 is rejected.
