In the matter of : An application under Sections 397, 401 and 482 of the Code of Criminal Procedure.

The present revisional application has been preferred against the order dated 08.02.2011 passed by the learned Judicial Magistrate, 2nd Court, Uluberia, Howrah wherein the learned Magistrate after appreciation of the contentions advanced by the wife in her application under Section 125 of the Code of Criminal Procedure was pleased to award maintenance of Rs.2000/- per month from the date of passing of the order.

Records reflect that the revisional application was preferred in the year 2012 and till date the same has not been admitted.

I have perused the order passed by the learned Magistrate which reflect that the learned Magistrate after considering the evidence by a detailed order was pleased to

arrive at a conclusion for awarding maintenance. The quantum so awarded is not excess thereby warranting interference by this court at this stage after nine years. Having regard to the totality of the circumstances and the manner in which the learned Magistrate assigned reasons for arriving at a conclusion, I am of the view that no interference is called for.

Accordingly, the present revisional application being CRR 888 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order so passed, if any, is hereby vacated. Department is directed to communicate this order to the learned Magistrate within a period of seven days from date. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
