21.12.2020 Sdas rejected C.R.M. 3247 of 2020 (via video conference) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Baranagar Police Station Case No. 314 of 2018 dated 24.05.2018 under Sections 376(2)(n)/506 of the Indian Penal Code read with Section 10 of the POCSO Act.

And In Re : Dipanjan Swarnakar @ Saheb ..... petitioner Mr. Koustav Bagchi ... for the petitioner Mr. N. Ahmed, learned A.P.P.

... for the State Statement of the minor victim discloses prima facie involvement of the petitioner in the alleged penetrative sexual assault on the victim.

Under such circumstances and as prayer for bail was rejected earlier and there is no change in the circumstances since then, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.
