Further instruction has been received from the West Bengal Board of Primary Education that all the seventy-eight vacancies in the para-teacher OBC-B Category have been filled up and no further vacancy is available for appointment.

As it appears that the petitioner scored marks less than the marks scored by the last empanelled candidate in the said category, accordingly, the petitioner do not have any scope for appointment.

There is no reason for interfering in the instant writ petition.

The writ petition fails and is hereby dismissed.

Instruction forwarded by the Board to the learned advocate be retained with the records.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
