The petitioner is in custody for more than a year and prays for bail.
Learned counsel for the State opposes the prayer and submits that the petitioner absconded for about four years before he was shown as arrested in this case during the pendency of another case under Section 302 of the Indian Penal Code against him. The petitioner happens to be the husband of the victim who died within three years of marriage. This Court is informed that the mother in law of the victim who is also a co-accused has absconded after being released on bail for which the trial cannot be proceeded with.
Considering the material on record as well as the conduct of the petitioner, this Court is of the view that the petitioner may further abscond if released on bail at this stage. Accordingly, prayer for bail is rejected, at this stage. The application for bail is disposed of.
