The petitioner's allegation against the bank can be agitated before the learned Debts Recovery Tribunal by filing proper application under Section 17 of the SARFAESI Act.

It goes without saying that unless there is an order of attachment or injunction in respect of other properties of the petitioner from the proper forum, the bank will restrict its claim to the mortgaged property. 3.

Accordingly, the writ petition is disposed of. 4.
