Noapara Police Station, Barrackpore Police Commissionerate has filed a report dated 31st March, 2023. The same is taken on record.

It appears therefrom that the petitioner has cooperated in the investigation in answer to the notice issued under Section 160 of the Code of Criminal Procedure and has submitted some documents regarding the transacted amounts from the Axis Bank account number ending 3050 to the ICICI Bank account number ending 0748.

It further appears that a sum of Rs.1,00,000/- (Rupees one lac only), in two tranches of Rs.50,000/- each, has been received by the petitioner, who is a supplier and dealer of medical equipments. According to the petitioner, he is a bona fide seller of the equipments to the FIR named accused.

In view of the above, this Court directs the ICICI Bank, Anandpur Branch, Kolkata to keep aside a sum

of Rs.1,00,000/- in an interest bearing account to the credit of the Investigating Officer of the case in connection with Naopara Police Station FIR No. 354 of 2022 dated 19th October, 2022.

The deposit account shall abide by any decision of the concerned Magistrate or the learned Sessions Judge, after final report is filed by the Investigating Officer of the case.

After creation of the deposit account, as indicated hereinabove, the ICICI Bank Account No. 128705000748 shall stand unfrozen and the petitioner shall be entitled to operate the same.

The petitioner shall, however, continue to cooperate with the investigation and if summoned as a witness, shall appear before the concerned Court. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
