Sandip Chakraborty, learned advocate appearing for the State submits that the investigation of the case has already concluded and the investigating agency is ready with the report under Section 173 of the Code of Criminal Procedure.

This revisional application has appeared on 17th August, 2021. On that date none appeared on behalf of the petitioner. Today also, when the matter is called on, none appears on behalf of the petitioner.

Having regard to the fact that the investigation has concluded and the chargesheet could not be submitted

because of the order dated 18th April, 2012 passed by a coordinate Bench of this court, I direct the investigating agency to file the chargesheet before the appropriate court as the same is ready. The earlier leave which was granted to the petitioner by the order dated 18th April, 2012 is, hereby, recalled.

The subject matter of the revisional application related to first information report and as the conclusion in respect of the same has been arrived at by the investigating agency, I do not want to interfere with the subject matter of the investigation at this belated stage.

Accordingly, the present revisional application being CRR 914 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order earlier granted is hereby vacated. The investigating agency within a fortnight from date would proceed to file their report under Section 173 of the Code of Criminal Procedure before the jurisdictional court.
