On perusal of the revisional application, it reveals that the issues so canvassed are questions of fact which are to be agitated in course of trial.
Having regard to the same, this Court is of the view that the petitioners would be at liberty to agitate such points in course of trial and argue the same at the final stage of the case after the defence witnesses have been examined.
In view of the aforesaid, no interference is called for.
Accordingly, the revisional application being C.R.R.916 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
