Petitioners and their family members pray for a direction upon the police to send a report to the SDO, Diamond Harbour not to seize arms and equipment and not arrest them for possessing arms even after expiry of licence.

This Court is of the view that the matter calls for absolutely no interference by this Court since the issue is within the exclusive domain of the S.P. and D.M. to take an independent decision on the seizure of the arms being held by the petitioners beyond the period of licence. The report of the Mandir Bazar P.S., Sundarban Police District dated 05.01.2023, addressed to State advocate is taken on record.

Let the D.M., South 24 Parganas and the concerned S.P. take an independent decision in the matter in accordance with law.

The writ petition is disposed of.

There will be no order as to costs.
