By consent of the parties the appeal and 11.04.2025 application are taken up together and disposed of by this common order.

Since the report of the Medical Board is inconclusive on the issue as to whether the teacher is suffering from serious gynecological disorder which would likely to cause serious discomfort during her travel from her place of residence to the school and returning from the school to her residence, we direct the Medical Board to re-examine the teacher within fortnight from date and submit a report to the DPSC, Murshidabad, clearly indicating the seriousness of the gynecological problem as urged by the appellant and the nature of discomfort likely to

suffer during her travel, for consideration of her transfer. A copy of the said report shall also be made available to the appellant.

DPSC, Murshidabad shall re-consider the matter on the basis of the medical report to be filed by the Medical Board in terms of this order within two weeks after receipt of the medical report and communicate its decision to the appellant within a week thereafter from the date of taking final decision.

In view of the above, the order of the learned Single Judge is accordingly set aside.

On such consideration, the appeal being MAT 416 of 2025 stands disposed of.

In view of the disposal of the appeal nothing remains to be decided in the application for stay being CAN 1 of 2025 and the same is accordingly disposed of.
