1. CRR 1414 of 2024 is specially assigned to this Bench by the Hon'ble Chief Justice by an order dated March 5, 2025.

2. We issued a Rule on finding that, an application for bail made by a co-accused contained a statement which was incorrect. While obtaining bail, such co-accused stated that, all other co-accuseds were on bail while, one co-accused was granted bail at that relevant point of time.

3. Private opposite party filed an affidavit claiming that due to the inadvertence of the learned Advocate, such mistake was committed.

4. Learned Advocate representing the private opposite party before the jurisdictional Court affirmed an affidavit on May 16, 2024 acknowledging that, the mistake was his. Such

Advocate was also stated that, the mistake was committed inadvertently.

5. Given the explanations of the learned Advocate for the private opposite party who represented him before the jurisdictional Court and as contained in the affidavit dated May 16, 2024 of his, we deem it appropriate to discharge the private opposite party of contempt Rule.
