1. Present petition has been filed by the petitioner challenging the inaction of the Secretary, Public Vehicles Department in not taking any decision on the representation of the petitioner dated 18th February, 2026 for removal of system lock allowing fitness test of vehicle and renewal of permit being No. 009/S-176/2003, route S-176 vehicle No. WB-19D/9111.

2. Learned counsel for the petitioner submits the concerned authority has not even responded to such communication.

3. Learned counsel submits that petitioner would be satisfied if an appropriate direction is issued to the authority concerned for taking a decision on such representation.

4. Learned Government Pleader has fairly submitted that the concerned authority shall

consider and decide the representation in accordance with law after giving opportunities of being heard within a reasonable time.

5. In the facts and circumstances of this case the present petition is disposed of with a direction to respondent No. 4 to consider and decide the representation dated 18th February, 2026 within a period of four weeks from the date of communication of this order in accordance with law after giving the parties an opportunity of being heard.

6. Concerned authority shall communicate the order within a week. The concerned authority shall take into account the notification dated 17th November, 2025.

7. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities. (Dinesh Kumar Sharma, J.)
