Kausik CRM (NDPS) 554 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chanchal P.S. Case No. 86 of 2026 dated 29.01.2026 under section 21(c)/22(c) of the NDPS Act.

Learned advocate appearing for the petitioners submits that the subject matter of the case relate to alleged recovery of 52 bottles of Phensedyl. Petitioners are in custody for 63 days. Learned advocate for the State opposes the prayer for bail and submits that investigation of the case is still in progress.

Having considered the present stage of the case, I direct the learned Trial Court that in case there is no further recovery from the present petitioner, learned Trial Court after submission of the charge sheet will release the petitioners on

bail on such terms and conditions as he deems fit and proper for ensuring appearance during the trial.

With the aforesaid observations CRM (NDPS) 554 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
