Bikram Mandal v. State Of West Bengal
18.04.2022 Sl. 50 Court No.29 suvayan (rejected) C.R.M. (DB) 977 of 2022 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 07.04.2022 in connection with Baishnabnagar P.S. case No. 101 of 2019 dated 26/02/2019 under Sections 363/365/34 of the Indian Penal Code, 1860 and added Sections 6/17 of the POCSO Act, 2012.
And In the matter of: Bikram Mandal ....petitioner.
Mr. Anirban Mitra Md. Wasim Akram ...for the petitioner.
Ms. Zareen N. Khan Md. Kutub Uddin ...for the State.
Petitioner renews the prayer for bail.
Learned Advocate appearing for the petitioner submits that the victim girl was examined at the trial. There are contradictions in an evidence.
Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary and to the earlier order of rejection.
The evidence of the prosecution and the defence witnesses are to be evaluated at the trial.
There is hardly any material change in circumstances subsequent to the earlier order of rejection dated February 8, 2021. The trial is in progress. We, therefore, do not find any reason to the petitioner enlarge on bail.
Accordingly, the prayer for bail of the petitioner is rejected. C.R.M. (DB) 977 of 2022 is dismissed.
