The alleged contemnor no. 1, namely, Narayan Swaroop Nigam, Secretary, Department of Health, Government of West Bengal, is personally present in court and tenders his unconditional apology for delayed compliance of our order dated August 10, 2021. The compliance report in the form of affidavit is filed in court today on behalf of the alleged contemnor no. 1. Let the same be taken on record.
Mr. Tapan Kumar Mukherjee, learned advocate appearing on behalf of the alleged contemnors, submits that his junior, Ms. Debdooti Dutta, learned advocate, filed vakalatnama on behalf of the alleged contemnor no. 1 in the department under filing no. A-11155 on June 24, 2022.
Office is directed to incorporate the vakalatnama, as aforesaid, in the records of this case.
It appears that the petitioner has since been appointed in the post of General Duty Attendant. The
learned advocate appearing on behalf of the petitioner submits that the case of the petitioner may be considered against Group-C posts.
We feel that it will be the discretion of the appointing authority against which posts the petitioner would be considered.
The contempt application is, thus, disposed of. Personal appearance of the alleged contemnor no. 1 is dispensed with.
There will be no order as to costs.
