Report pursuant to the last order dated February 25, 2025 filed on behalf of the Life Insurance Corporation is taken on record. It appears therefrom that due to discrepancies in the derivations of the cause of death of the life assured, accidental benefit could not be granted to the petitioner.

Medical certificate annexed to the writ petition records that the death took place because of the injuries caused.

The communication of the Assistant SubInspector of Police, Rampurhat police station dated January 31, 2020 addressed to the Inspector in-charge, Bidhannagar (South) police station (Annexure P3, p.23) mentions that on 26th January, 2020 the person was going to Rampurhat police station for duty when he suddenly fell down from his motorcycle and received bleeding injury on his head. He was taken to Rampurhat HD Hospital by the local people and thereafter referred to Railway B.R. Singh Hospital wherefrom he was further referred
to AMRI Hospital, Salt Lake on 27th January, 2020 where he succumbed to his injuries on January 30, 2020. A case has been recorded in the police station.

The prayer of the petitioner for disbursal of the accidental benefit has been rejected. It has been mentioned in the report that there are adequate grievance redressal mechanism and internal appellate forum within LICI. There is a permanent Zonal Office Claim Dispute Redressal Committee which, on appeal made to it by an aggrieved claimant, may review the decision taken by the divisional office. If the claimant is dissatisfied with the decision of the zonal office, there is provision for appeal before the Central Office Claim Dispute Redressal Committee.

In view of the above, the petitioner is granted liberty to approach the appellate forum along with all documents.

In the event the petitioner approaches the appellate forum, steps shall be taken to decide the prayer of the petitioner in accordance with law at the earliest, but positively within eight weeks from the date of making the appeal.

The writ petition stands disposed of.
