Earlier, there was a direction by this Court in CRM(M) 993 of 2025 that the learned trial court should pronounce the verdict of the case by 15th March, 2026. Learned advocate submits that till date the evidence has not been concluded, as such, the petitioner may be released on bail. A report has been submitted by the investigating officer of the case which reflects that the examination of p.w.17 is in progress.
The learned trial court is directed to give priority to the evidence of this case since the case is at an advanced stage. The learned trial court would, within 30 days from the next date, conclude all the prosecution witnesses. In case, the defence do not tender any witness, then, in such circumstances, the learned trial court would, after examination under section 313 Cr.P.C. is complete, within a fortnight from the said date pronounce the verdict. The whole exercise may be completed by 10th July, 2026. The trial of the case would continue inspite of any resolution of the local Bar and no unnecessary adjournment be granted to any of the parties.
Considering the stage of the case, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.
Accordingly, CRM (M) 768 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
