A direction to secure expeditious disposal of an application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997, is the ultimate relief sought for in this case.

Mr. Animesh Paul, learned advocate appearing for the petitioner/plaintiff submits that in the pending suit, the application under Section 7(2) of the WBPT Act was filed on 17th November, 2020. Since then the pending interlocutory application has not yet been disposed of.

The only contention thus expressed by the learned advocate appearing for the petitioner is against the delay caused in the disposal of petition under Section 7(2) of the WBPT Act.

In view of the nature of the order proposed to be made in this case, referred above, no prior notice is considered to be necessary.

Service upon the opposite party is thus dispensed with.

Accordingly, learned Civil Judge (Junior Division), 3rd Court, Howrah in Title Suit No. 755 of 2020 is requested to ensure expeditious disposal of

pending interlocutory application particularly under Section 7 (2) of the WBPT Act, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party as well. With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
